Article 246. Parricide. - Any person who shall kill his father, mother, or child, whether legitimate or illegitimate, or any of his ascendants, or descendants, or his spouse, shall be guilty of parricide and shall be punished by the penalty of reclusion perpetua to death. (Art. 246, Revised Penal Code)

Parricide is committed when (1) a person is killed; (2) the accused is the killer; and (3) the deceased is either the legitimate spouse of the accused, or any legitimate or illegitimate parent, child, ascendant or descendant of the accused. (People v. Delos Santos, G.R. No. 248929, November 09, 2020)

INFORMATION 

The undersigned Assistant City Prosecutor hereby accuses Aku Sado of the crime of Parricide, defined and penalized under Art. 246 of the Revised Penal Code, committed as follows:

That on or about 7:30 in the evening of November 21, 2021 at 2222 Hormiga Street, Brgy. Valenzuela, Makati City, Philippines and within the jurisdiction of this Honorable Court, the above-named accused, with intent to kill, with treachery and evident premeditation, did then and there, willfully, unlawfully and feloniously attack, assault and stab his father, PEDRO SADO, using a bladed weapon, thereby inflicting upon the latter mortal wound on the chest that caused PEDRO SADO's instantaneous death.
